TERME DI SIRMIONE-SPA & THERMAL GARDEN SERVICES (formerly called AQUARIA)
Article 1. Object
On the website https://spathermalgarden.termedisirmione.com (formerly https://aquaria.termedisirmione.com/it), customers can purchase Gift Vouchers, which allow them to choose when to enjoy the thermal experience, or pre-booked services for a desired date/time.
This website is intended for end customers only and not for business customers (who can contact events@termedisirmione.com instead). Below are further details:
1.1 Gift Vouchers
•A Gift Voucher is an electronically generated document issued by Terme di Sirmione that entitles its holder to use the services specified therein.
•The booking and use of the service must take place within 12 months from the date of purchase (unless otherwise stated) and are subject to the restrictions and limitations detailed below.
•Each Gift Voucher is identified by a unique alphanumeric serial code, which the consumer must provide at the time of booking to validate its use.
•The voucher can be transferred to another person as a gift.
1.2 Pre-booked services for a specific date/time
•At the time of purchase, the customer selects a specific date and time for their visit to the facility.
•A confirmation email is automatically generated, detailing all the booking terms. No further contact with Terme di Sirmione is required.
Article 2. Purchase Process
•Customers must ensure that all fields are correctly completed before submitting the order.
•A purchase is finalized when Terme di Sirmione sends a confirmation email and the payment is successfully processed.
•Customers purchasing Gift Vouchers or pre-booked services through https://spathermalgarden.termedisirmione.com accept these GENERAL TERMS AND CONDITIONS in full.
Article 3. Prices and Payment Methods
•Prices are displayed in euros (€) and include VAT.
•Payment is accepted via Credit Card (Visa, VPay, Mastercard, Maestro).
•Payments are processed securely via SSL encryption.
•The purchase functions as a deposit.
•An invoice can be requested at the time of payment.
Article 4. Booking Terms
4.1 Pre-booked services
•The date and time are already selected during the purchase process.
4.2 Booking services included in a Gift Voucher
• To schedule the date and time for the services listed on the Gift Voucher (including ‘entry only’ bookings), the Beneficiary must book through the portal spathermalgarden.voucher.termedisirmione.com.
•Bookings can be made 48 hours after purchase.
•The availability displayed online does not always match the availability for special promotions.
Article 5. Modifications and Cancellations
•Bookings can be canceled or modified via the website.
•Free cancellation is possible up to 24 hours before the scheduled visit.
• If you hold a voucher, any rebooking must be made through the portal spathermalgarden.voucher.termedisirmione.com. In the event of a cancellation without a new booking, or if six months have passed since the cancellation date—and in any case beyond the voucher’s expiration date—the right to the services will be forfeited, and no refund for the purchased service will be provided.
• Cancellations within 24 hours are non-refundable.
Article 6. Eligibility
•Customers must be 18 years or older.
•False information may result in denied access to services.
Article 7. Customer and Beneficiary Data
•The customer is responsible for providing accurate information.
•If a Gift Voucher is sent to the wrong email due to customer error, Terme di Sirmione is not responsible.
Article 8. Fraud Prevention
•Gift Voucher holders must keep their codes secure.
•In case of loss or theft, the customer must notify Terme di Sirmione in writing.
Article 9. Liability
•Terme di Sirmione does not guarantee continuous website availability due to technical issues or force majeure.
Article 10. Right of Withdrawal
•Customers may withdraw within 14 days for Gift Voucher purchases only.
•No withdrawal is possible for services booked for a specific date.
Article 11. Service Usage Terms
•Customers must arrive on time for their bookings.
•Late arrivals may result in loss of service.
Article 12. Service Availability Limitations
•In cases of bad weather, overcapacity, or technical reasons, Terme di Sirmione reserves the right to modify service availability.
•No refunds will be issued for temporary closures.
Article 13. Governing Law and Jurisdiction
•Contracts are governed by Italian law.
•The exclusive jurisdiction is the Court of Brescia, Italy.
HOTEL SERVICES
•Bookings are confirmed via email.
•Non-refundable rates cannot be modified or canceled.
•Customers must comply with applicable COVID-19 regulations.
•For reservations of more than 5 rooms, Terme di Sirmione reserves the right to apply specific commercial conditions and confirm actual availability according to the policies provided for groups. These reservations are subject to dedicated rates and terms, which differ from the standard policies applied to ordinary bookings made online.
